Michael Madsen Files for Restraining Order amid Divorce from Estranged Wife DeAnna After 28 Years of Marriage

In court documents obtained by PEOPLE, the 'Kill Bill' actor alleged his wife drove their son Hudson to die by suicide in January 2022

Michael Madsen has filed for a temporary restraining order against his estranged wife, DeAnna Madsen.

Per court documents obtained by PEOPLE, the Kill Bill actor, 66 — who filed for divorce from his wife of 28 years on Tuesday, Sept. 17 — has now requested a domestic violence prevention restraining order for him and the former couple's son Luke, 18, who is listed in the filing under "other protected people."

Michael and DeAnna, 64, who married on April 15, 1996, also share son Calvin, 27, together. Their 26-year-old son Hudson died by suicide in January 2022.

Michael's Los Angeles court request comes after he included a statement among his divorce documents, claiming he was requesting a domestic violence restraining order against DeAnna.

In the filing, the actor said he and DeAnna had separated shortly after their son Hudson's death on Jan. 25, 2022.

In the statement attached to the divorce petition as part of the legal documents, the actor accused his estranged wife of driving their son to die by suicide "by her neglect, drinking and alcoholism," insisting the "irreconcilable differences" he'd listed did "not adequately describe the divorce filing."

He also denied the recent domestic violence charges brought against him by DeAnna last month.

"Respondent also significantly contributed to my personal issues as well. I am a victim in an abusive, co-dependent, and toxic relationship that culminated in the Respondent breaking into my residence and having me wrongfully arrested for DV," Michael, who is being represented by his longtime attorney Perry Wander, alleged in the statement.

Michael's representatives didn't immediately respond when contacted by PEOPLE for comment.

As reported by PEOPLE on Aug. 19, the Reservoir Dogs actor had been released from jail after being taken into custody in Malibu in the early hours of the morning two days prior on Aug. 17. He was arrested under California Penal Code section 243(e)(1), which is battery of a spouse, and his bail had been set at $20,000.

Madsen's attorney previously told The Hollywood Reporter that DeAnna had reportedly been asked "to leave" the house after the star "confronted" her, and that "he's definitely not guilty of domestic violence."

DeAnna responded, "Michael is struggling with his own personal issues. Myself and our children have been supporting him to the best of our ability. We would request privacy at this time," per the outlet.

Following the death of the estranged couple's son Hudson in January 2022, Michael shared a statement with the Los Angeles Times.

“I didn’t see any signs of depression. It’s so tragic and sad. I’m just trying to make sense of everything and understand what happened,” he said at the time.

Madsen is also father to sons Christian, 34, and Max, 30, from a previous relationship with Jeannine Bisignano.
