Alec and Hilaria Baldwin Are 'Enjoying Family Time' in the Hamptons After “Rust” Case Dismissal (Source)

A source tells PEOPLE that the pair "can finally breathe again" as they spend time with their kids

Alec and Hilaria Baldwin are surrounding themselves with family after the dismissal of the actor's involuntary manslaughter case earlier this month.

Weeks after Alec's charges in the Rust shooting trial were dropped by a judge on July 12, a source tells PEOPLE that the actor is now enjoying his summer in the Hamptons with his wife and kids.

"They can finally breathe again," the source says. "They're enjoying the summer in the Hamptons with the kids. Summer was pretty much postponed until Alec's trial was over."

"They feel grateful that they're able to relax a bit now. Everyone’s enjoying the family time," the source adds.

The actor, 66, was on trial nearly three years after the gun he was holding on the set of his film Rust in October 2021 discharged and killed cinematographer Halyna Hutchins, also injuring director Joel Souza.

Judge Mary Marlowe Sommer ultimately had the case dismissed with prejudice after Alec's legal team argued that "critical" evidence — specifically ammunition discovered by a man named Troy Teske (a friend of the father of convicted Rust armorer Hannah Gutierrez-Reed) — "was never disclosed to us."

After the ruling, a source told PEOPLE that the couple — who hugged each other upon hearing the news in court — were "relieved" that it was over.

"It's been a sad situation, and there is no winning here. They didn't celebrate," the insider said. "They were very worried and are grateful now that they are able to spend the rest of the summer with their kids."

The dismissal of charges came during the third day of the New Mexico trial, after Alec's attorney Luke Nikas claimed the State violated the Brady rule, which requires prosecution to “disclose material, exculpatory information in the government's possession to the defense,” per the Cornell School of Law.

“The late discovery of this evidence during trial has impeded the effective use of evidence in such a way that it has impacted the fundamental fairness of the proceedings,” said Judge Sommer, in part.

Alec has since put out a statement about the outcome in a July 13 Instagram message, writing, "There are too many people who have supported me to thank just now. To all of you, you will never know how much I appreciate your kindness toward my family."

He and Hilaria, 40, later stepped out for their first red carpet appearance since the trial on July 20, when they attended a screening of War Game at the Hamptons International Film Festival's SummerDocs series in East Hampton, New York.

Alec waved at fans and smiled on the red carpet during the outing.

The pair, who share seven children, are planning to give fans a look at their family dynamics in a new TLC series arriving in 2025, titled The Baldwins.

They announced the series on Instagram, inviting viewers to "experience the ups and downs, the good, the bad, the wild and the crazy" of their lives at home.
