Shoe Wars: Christian Louboutin vs YSL

Christian Louboutin's legal team has issued a preliminary injunction banning YSL from producing high heel shoes with red soles.

Louboutin officially filed the complaint against YSL in April after the fashion house produced an all-over red shoe.

While Louboutin's lawyers argued at Friday's hearing that the shoe causes confusion for the average consumer, YSL's lawyer, David Bernstein retorted, "we don't think that any fashion designer should be able to monopolise any colour".

Bernstein went on to argue that Louboutin's trademark red sole should never have been granted in the first place.

Meanwhile, Louboutin's lawyer Harley Lewis stated that unless the average consumer "is living in a cave" they will recognise the distinct red sole of a Louboutin shoe and become confused upon viewing the YSL design.

"We are not claiming to own every red under the sun. There's a particular red that Christian uses on his shoes, a bright, lacquered red," said Lewis. "We aren't saying burgundy or orange-red, we aren't saying pink. We don't own any other red but that red."
