1. Information on "how to enter" and prizes form part of conditions of entry. Entry into this competition deems acceptance of these terms and conditions.
2. Enter as many times as you wish, by telling us in 100-words-or-less, your answer to the question posed in Home Beautiful Magazine cover dated 14 September 2009. Each written entry must be on an original entry form found in the magazine and sent to Home Beautiful Desperate Kitchens Competition PO Box 152 Eastern Suburbs MC NSW 2004.
3. All entries must include a 100-words-or-less answer to be eligible to win. Entries must also have enclosed current photographs or other relevant documents of the entrant's kitchen from the address the entry was submitted for. Entrants must ensure that all parts of the submitted entry clearly state all contact details of the entrant for ease of identification by the promoter during the judging stage.
4. Entry is open to all residents of Australia except employees and immediate families of the Promoter, associated companies and agencies and participating outlets. The Promoter is Pacific Magazines Pty Ltd, 35-51 Mitchell Street, McMahons Point, NSW, 2060 (ABN 16 097 410 896).
5. The competition commences on 14 September 2009 at 09:00 and closes on 12 October 2009 at 17:00 AEDT. The winner will be the best valid entry selected by the judging panel, having regard to skill, creativity and originality, at the Promoter's premises on 23 October 2009 at 11am.
6. Total prize value is $40,000, as at 31/07/09. One major winner will receive kitchen fittings from IKEA Kitchens to the value of $15000 and kitchen appliances from Whirlpool to the value of $15,000. Runner up prizes include:

10 x $500 Whirlpool gift vouchers
7. The major winner must: Choose kitchen fittings from within the IKEA Kitchens range only and appliances must only be selected from the Whirlpool range. Failure to choose from these two ranges will deem a winner invalid from any point in the prize fulfilment stage. Another winner will be chosen from the initial judging pool of entrants. Prize winners may be required to sign an agreement to this effect prior to being awarded the major prize.
8. The major winner must install the kitchen by the deadline set in consultation with the promoter. Anything uncompleted or uninstalled by the deadline will be forfeited by the winner.
9. Any costs that exceed the aforementioned prize pool must be met by the winner and neither the promoter nor any prize sponsors will be held liable to complete such works. If it is agreed upon that IKEA Kitchens and Whirlpool will complete such works that exceed the prize pool, scope or deadline, the winner must pay the usual rates for such products and/or services. In such an event, the rights and obligations stated herein are reserved.
10. Should the installation cost less then the prize pool stated herein, cash will not be awarded in lieu of any deficit.
11. The winner will be notified by mail and will be published online at www.homebeautiful.com.au on 16 November 2009.
12. Please allow 8 weeks for arrangements for installation to be made by the promoter.
13. All entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter. Parent or guardian may be called to verify consent and be required to sign a release at the discretion of the Promoter. If a winner of the prize is under the age of 18 as at the judging date, an adult must accompany the minor in the participation of the prize.
14. One entry per entry coupon.
15. All competition entries must be able to be posted to and received at the post office box address supplied for the particular competition. No hand delivered or bulky entries will be accepted upon receiving at the Promoters premises for any competition, unless otherwise stated herein. Any entries that do not follow these requirements will be deemed invalid and will not be received by the Promoter or its agents. The Promoter and its agents take no responsibility whatsoever for such entries that do not follow these prescribed guidelines. The Promoter advises entrants not to send entries to the Promoter's street address as these entries may be deemed invalid.
16. The promoter highly recommends a DL sized (business) envelope is used in submitting postal entries. The promoter also encourages competition entrants to clearly print full addresses and names on envelopes as clear as possible for ease of processing by Australia Post and therefore entry into the competition.
17. The promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery and eventual installation of the kitchen. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrants. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be resent to the prize winner.
18. Photos that are copyrighted should not be submitted unless you have permission from the photographer/owner. Photos cannot be returned. By entering the competition entrants agree and understand that their written entries and/or photos may be used for promotional purposes without any further reference, payment or other compensation to the entrant and/or owner of the photograph. Entrants under the age of 18 must seek a parent or adult/guardians permission to send any photo to the Promoter to enter a promotion.
19. All entrants must submit ONLY their own original answers, designs and works. Any such answers, designs or works cannot be previously published in any forum worldwide. All entries become the property of the Promoter and cannot be returned. Entries that are found to have been derived from the designs of a third party will be considered invalid and, if awarded a prize, that prize must be returned to the Promoter. The winner may be required to sign a statutory declaration regarding the originality of the entry. Without limiting the generality, the Promoter reserves the right to take legal action against anyone found to have breached this term. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation are reserved.
20. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier's requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated by the deadline.
21. If the Promoter is unable to contact the winner within a reasonable time to claim fulfilment of the promotional prize, that winner will forfeit the prize in its entirety and it shall be awarded to the first runner up in the promotion. A new runner up shall then be judged. The Promoter will not be liable for a winner who cannot be contacted and therefore forfeits their prize.
22. The Promoter reserves the right to request winners to provide proof of identity, proof of residency, proof of age at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.
23. The Promoter reserves the right to rejudge in the event of an entrant, claiming to be a winner, being unable to satisfy these Terms and Conditions.
24. The judges' decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining any winner. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner's nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit.
25. All entries and any copyright subsisting in the entries become and remain the property of the Promoter who may publish or cause to be published any of the entries received. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including, but not limited to, mail, telephone and commercial electronic messages. The Promoter may share information with its Pacific related companies or promotional partners who may contact entrants in this way with special offers.
26. By entering the promotion, each entrant agrees that the Promoter may use entrants' personal information in this manner. The entrant also agrees that the Promoter may publish or cause to be published the winner's name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Privacy Officer, Pacific Magazines Pty Ltd, 35-51 Mitchell Street, McMahons Point, NSW 2060. All personal information will be securely stored by the Promoter. Pacific Magazines and their related companies pride themselves on quality information and communication to its valued customers. If you consent, we would like to contact you for an unlimited period to keep you informed about future products, services and events, until you decide to opt out.
27. In participating in the prizes, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The winners (and their companions) agree to granting the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners (and their companions) will not be entitled to any fee for such use.
28. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize.
29. Winners of any age may be required to provide satisfactory identification and sign a winner's deed of release or any other relevant forms or agreements that the Promoter deems necessary before a prize can be awarded.
30. The Promoter shall not be liable for any loss or damage whatsoever suffered, including but not limited to direct or consequential loss, or personal injury suffered or sustained during the course of prize winning trips or in connection with the redemption of and/or use of any other prizes. Any change in value of the prize occurring between the publishing date and date the prize is claimed is not the responsibility of the Promoter.
